Proposition 36

In 2000, voters within the state of California approved a Substance Abuse and Crime Prevention Act, also known as “Proposition 36” or “prop36”.  Proposition 36 is an act that protects people who have been charged with misdemeanor drug and/or alcohol related offenses, who have committed non-violent drug and/or alcohol offenses, or who have committed simple drug and/or alcohol related offenses for the second time.  The Act protects these people by allowing them to seek drug and/or alcohol rehabilitation or treatment instead of spending time in jail.

In order to make Proposition 36 effective, the state of California budgeted nearly 120 million dollars for treatment services after passing the Act.  On an annual basis, over 30,000 people enter into drug and/or alcohol treatment programs via Proposition 36 instead of being incarcerated.  In California, the majority of voters believe that a person will get more value from treatment programs than from imprisonment.  It is also believed that after thorough rehabilitation, a person will be less likely to commit another drug crime in the future.

After a person has been convicted of a drug crime in Orange County, he/she may be eligible for Proposition 36.  If he/she is found to be eligible for prop36, he/she will be placed on probation and asked to undergo drug and/or alcohol treatment for a year.  The person may also be asked to submit to drug testing on a regular basis and other terms deemed necessary by the court.  After a year, if the person has adhered to the court terms and completed his/her treatment program, his/her drug crime charged may be dismissed.
